I have an old H1B visa with approval date December 19, 2000. I moved to US in Jan 2001 and spend only 2 months in USA in total. Stay outside USA from Mar 2001 until now.
Can I apply for the remaining time against my initial six-year period of admission and will be exempted from the cap?

It looks like the rumors are no more circulating of people being deported.

Recently my I-140 petition for EB2 was denied on educational grounds . The employer opened an MTR/appeal.
Is it possible to re-file the I-140 petition in EB3 using the same labor certification, while the first I-140 is pending appeal at AAO.

Here is something we really should watch closely. US senate race in Massachusetts between Democrat Coakley and Republican Brown. They are fighting for the vacant seat of Hon. Late Senator Ted Kennedy. Now, people would think, why a race in mass. matter? It's a completely blue state, and had no republican senator in last 40 yrs, obviously a democrat would win. The election is on tuesday and the ground reality seems to suggest something else.
This seat is crucial for President and Democrats as it is the much coveted 60th seat in the senate to get a filabuster-proof majority which democrats have enjoyed so far. It is critical for healthcare reform as well as for immigration reform (if at all it comes).
The gap between both the candidates was narrow with democrat leading but today, for the first time, polls indicate that Brown has taken lead over Coakley. People in this blue state seem to increasingly support Brown, mainly frustrated because of healthcare policies. Mass residents already have a healthcare related tax to help run state's universal health care. On top of that, federal health overall would be adding more taxes on people and people fear that they will end paying both. Already, mass is a very high tax state. So, there is an increasing popularity to tax-related fiscal conservative campaign run by Brown.
This is surely gonna be a nail-biter; so let's wait and watch this one. Election is coming tuesday.

My GC was started by a company A with priority date of June 2004 in EB3. 140 was approved and filed 485 in July 2007 when all gates opened. In parallel, a friend of mine started my GC processing under EB2. That has a priority date of March'2005. Current date for EB2 is Feb.2005.
I got an offer from a different company (company B), which I would like to take if I have no issues with GC etc. I am thinking what should be my plan of action. I have the following options:
1. Join company B on contract to hire on EAD that I got from company A as an employee of my friend's company. Apply 485 when EB2 becomes current for March 2005. Hopefully I will get my GC in an year and I join company B.
2. Join company B on EAD (or H1) and ask them to re-start my GC process under EB2. Issue with this is it may take a long time for my GC as PERM is taking longer nowaways.
3. Continue with my present employer and get my GC in 2020!..

I live in NJ and my application was recieved on July 2nd. would that be Nebraska or Texas SC?
NJ comes under TSC but direct filing took effect only from July 30th. Till then the 485 was supposed to be sent to the center where 140 is filed or to NSC ( if no 140 filed). Even if it was sent to the wrong center USCIS will not reject the application in this timeframe. It will be internally transferred to the the correct service center.

He said that, at the same time, the US government has framed a policy for the companies to give preference to native Americans in employment.
Obama administration has taken up a practical approach in establishing relations with the countries while there were efforts in strengthening relations with India because of the "Brain Borrowing", he said.

Since when has more money than the prevailing wage been a problem?
If they pay you via a check to the company you own, then they will be paying for services rendered. They will not be paying employment taxes(SS+Medicare) on that check amount. You will end up paying Self employment taxes amounting to 15.2% on this amount instead of the 7.6% had it been part of your W2.
As far as the impact to the GC process. I dont think the excess amount should be a problem, but pls confirm with an imm.attorney
